1. DEFINITIONS
Lokalia / Service Provider: Axelle Tech LTD, a company registered in England and Wales (Company Number: 16311724)
User / Customer: Any individual or entity using Lokalia services, including restaurant guests and restaurant operators
Services: The Lokalia digital menu webapp, restaurant dashboard, AI chat assistant, and getlokalia.com website
Agreement: These Terms of Use
Restaurant Partner: Business entities using Lokalia's restaurant dashboard services

3. GENERAL PROVISIONS AND SCOPE
These Terms of Use ("Agreement") govern the relationship between Lokalia and Users regarding the use of digital menu services provided through Lokalia's websites and webapp, in accordance with:
- Turkish Law No. 6502 on the Protection of Consumers
- Regulation on Distance Contracts
- Turkish Electronic Commerce Law No. 6563
- UK Consumer Rights Act 2015
- UK GDPR and Turkish KVKK
By using Lokalia services, you agree to comply with and be bound by this Agreement. Both parties acknowledge and accept these terms by engaging in use of the Services.
4. SERVICE DESCRIPTION
Lokalia provides:
- Guest Digital Menu: A web-based menu viewing and ordering interface for restaurant guests
- Restaurant Dashboard: Management tools for restaurant operators including customer analytics
- AI Chat Assistant: An intelligent assistant to help you explore menu items and get recommendations
5. ELIGIBILITY
You must be at least 18 years of age to create an account. By registering, you confirm you meet this age requirement.
6. USER ACCOUNTS
6.1. Account Creation: You may optionally create an account using email/password, Google, or Apple sign-in.
6.2. Account Security: You are responsible for maintaining the confidentiality of your credentials and all activities under your account.
6.3. Accurate Information: You agree to provide accurate, current, and complete information. You commit that the information you provide is complete, accurate, and up to date, and that you will promptly update it if any changes occur. Lokalia will not be liable if you do not provide updated information.
6.4. Profile Information: You may optionally upload a profile photo. By uploading a photo, you confirm you have the right to use it and consent to its processing as described in our Privacy Policy.
7. ACCEPTABLE USE
You agree NOT to:
- Use the Services for unlawful purposes
- Attempt to gain unauthorized access
- Interfere with the proper functioning of the Services
- Upload malicious code or inappropriate content
- Impersonate others
- Use automated systems to access the Services without permission
- Provide false or misleading information
8. INTELLECTUAL PROPERTY
All content, features, and functionality of the Services (texts, graphics, logos, images, software, etc.) are owned by Lokalia or its licensors and protected by international copyright, trademark, and other intellectual property laws. Restaurant menu content remains the property of respective restaurants. Unauthorized use is prohibited.
9. DATA PROCESSING
9.1. We process personal data in accordance with our Privacy Policy and applicable data protection laws including UK GDPR and Turkish KVKK.
9.2. For AI Chat features, your messages are processed using artificial intelligence technology. See our Privacy Policy for details.
9.3. Limited Service Warning: You acknowledge that if you request that any of your personal data not be used by Lokalia, you may not fully benefit from the operation of the Services. Any responsibilities arising from limited functionality in this context will be yours.
10. THIRD-PARTY SERVICES
The Services integrate with third-party service providers for:
- AI-powered menu assistance
- User authentication
- Email delivery
- Restaurant point-of-sale systems
Your use of these integrated services is subject to their respective terms. Your personal data may be stored on servers worldwide to the extent necessary for providing these services, as described in our Privacy Policy.
11. ELECTRONIC COMMUNICATION CONSENT
By creating an account and accepting these Terms, you consent to receive:
- Service-related communications (account updates, security alerts, transaction confirmations)
- Technical notifications and system updates
Marketing and promotional communications require separate opt-in consent and can be withdrawn at any time.
12. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Lokalia strives to ensure the accuracy of the information provided but does not guarantee that the content is error-free. Users access the Services at their own risk.
13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOKALIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
For Restaurant Partners (B2B): Total liability is limited to fees paid in the 12 months preceding the claim. If the Restaurant Partner defaults on payments, they will be liable for interest as per applicable commercial law and responsible for collection costs.
14. INDEMNIFICATION
You agree to indemnify and hold harmless Lokalia from claims arising from your use of the Services or violation of these Terms.
15. MODIFICATIONS
Lokalia reserves the right to modify this Agreement at any time. Changes become effective upon being posted on the website. Continued use after changes constitutes acceptance. Material changes will be notified via email or in-app notification. Users are encouraged to review the Agreement regularly.
16. TERMINATION
We may suspend or terminate your access for violation of these Terms or for any reason with reasonable notice. You may terminate by discontinuing use and deleting your account.
17. AGREEMENT COMMENCEMENT
This Agreement commences when you first access or use the Services, or when you create an account. For Restaurant Partners, this Agreement also commences upon subscription to paid services.
18. GOVERNING LAW AND JURISDICTION
For Consumer Users in Turkey: These Terms are governed by Turkish law, including Law No. 6502 on the Protection of Consumers. Disputes shall be resolved by Turkish Consumer Courts or Consumer Arbitration Committees at the consumer's place of residence.
For Business Users / Restaurant Partners: These Terms are governed by the laws of England and Wales, with exclusive jurisdiction in the courts of England and Wales, except where Turkish law mandatorily applies. Any disputes arising from this Agreement shall be subject to Istanbul Courts and Enforcement Offices where Turkish jurisdiction applies.

20. OTHER PROVISIONS
20.1. Severability: If any provision of this Agreement is found invalid, the remaining provisions shall continue in effect.
20.2. Entire Agreement: This Agreement, together with the Privacy Policy and Cookie Policy, constitutes the entire agreement between you and Lokalia.
20.3. No Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
By using Lokalia services, you accept, declare and undertake that you have read and been informed of the terms of this Agreement and have given the necessary confirmation electronically.
